By accessing or using Alertitude ("the Service") at alertitude.eu, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.
2. Description of Service
Alertitude is an AI-assisted risk assessment platform designed to support planning for construction, infrastructure, and maintenance activities across the European Union and the United Kingdom. The Service generates structured risk reports with hazard registers, control measures, and legislation references based on EU Directives, national regulations, and applicable EN/ISO standards for the selected project country.
3. Not a Substitute for Professional Advice
The assessments generated by Alertitude are for informational and internal planning purposes only. They do not constitute:
- Professional engineering advice
- Legal safety compliance certification
- A replacement for site-specific risk assessments by qualified professionals
- A work permit or authorization to commence work
Always consult a qualified health and safety professional before commencing any work. The user is solely responsible for reviewing, adapting, and signing off every assessment for their specific site conditions.
4. User Responsibilities
By using the Service, you agree to:
- Use the platform only for lawful purposes
- Not input sensitive personal data, classified information, or confidential third-party data
- Independently verify all assessments before acting on them
- Ensure all work is conducted by qualified personnel with appropriate certifications
- Comply with all applicable local and national safety regulations
5. Limitation of Liability
To the maximum extent permitted by applicable law, Alertitude d.o.o. and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from:
- Use of or reliance on assessments generated by the Service
- Errors, inaccuracies, or omissions in AI-generated content
- Any decisions made based on platform output
- Interruption or unavailability of the Service
Your use of the Service is at your sole risk. This limitation does not affect your statutory consumer rights under EU or national law.
6. Intellectual Property
The Alertitude platform, including its design, code, branding, and content, is the property of Alertitude d.o.o. You may not reproduce, distribute, or create derivative works without prior written permission. Assessment reports you generate are yours to use for internal purposes.
7. Third-Party Services
The Service uses the Anthropic API to generate assessment content. Use of this Service is also subject to Anthropic's Usage Policies. Alertitude is not responsible for the accuracy or availability of third-party AI services.
8. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
9. Data Protection
Your personal data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). By using the Service, you acknowledge that assessment metadata and anonymised usage data may be processed as described in our Privacy Policy.
10. AI-Generated Content
Alertitude is classified as a Limited Risk AI System under the EU AI Act (Regulation (EU) 2024/1689), Article 50. All generated content is clearly labelled as AI-generated. Users must review all output with a competent person before relying on it.
11. Payment and Digital Content
Assessments are paid per use via PayPal or card. By clicking "Generate", you consent to immediate delivery of digital content and acknowledge that your right of withdrawal under EU Directive 2011/83/EU (Article 16(m)) is waived once the assessment is delivered. An invoice is emailed automatically after each transaction.
12. Governing Law
These Terms are governed by the laws of the Republic of Slovenia and applicable EU regulations. This does not affect your statutory consumer rights under the laws of your country of residence.
13. Online Dispute Resolution
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but may choose to do so on a case-by-case basis.
